Medialdea Challenges ICC on Duterte’s Transfer, Cites ‘Abuse of Process

March 15, 2025 – The Hague, Netherlands

Former Philippine President Rodrigo Duterte appeared before the International Criminal Court (ICC) via video link, facing allegations linked to extrajudicial killings during his administration’s controversial “war on drugs.”

During the proceedings, Duterte’s legal counsel, former Executive Secretary Salvador Medialdea, challenged the ICC’s jurisdiction and questioned the legitimacy of the former president’s transfer into the court’s custody. Medialdea argued that the process amounted to an abuse of power, raising concerns about procedural fairness.

Presiding Judge Iulia Motoc responded by affirming that Duterte had been informed of his rights and the charges against him. The court acknowledged Medialdea’s objections but clarified that these concerns could be addressed in future hearings.

According to ICC procedures, the pre-trial stage determines whether there is sufficient evidence to proceed with a full trial. Suspects have the opportunity to challenge the prosecution’s case before a formal trial is set.

Duterte, who has repeatedly denied wrongdoing, faces accusations related to the thousands of deaths that occurred under his administration’s anti-drug campaign. The next hearing, scheduled for September 23, 2025, will determine whether the case will move forward.

What Happens Next?

The upcoming proceedings will focus on the confirmation of charges. If the court finds substantial evidence, a trial will commence—a process that could take years before reaching a verdict.

Duterte’s legal team has vowed to contest the case, maintaining that the former president acted within the bounds of Philippine law while implementing his anti-drug policies. Meanwhile, human rights advocates continue to push for accountability, emphasizing the need for justice for victims and their families.

The ICC case remains a highly controversial issue, drawing reactions from both supporters and critics of Duterte. With months left before the next hearing, the international community will be closely watching the developments of this historic legal battle.
