Court dissolves TRO, allows MisOr to spend 2020 budget

MISAMIS Oriental–The Regional Trial Court here ordered the dissolution of the temporary restraining order (TRO) banning Misamis Oriental to spend its approved 2020 budget.

In a three-page decision released Saturday, Presiding Judge Marites Filomena B. Rana-Bernales, of RTC, Branch 39, also said that the application for the writ of preliminary injunction (WPI) was also withdrawn.

The dissolution of the TRO also returns the “status quo” prior to the filing of the restraining order, which means that the provincial government of Misamis Oriental could, again, start spending the approved 2020 Budget ordinance.

Provincial Governor Yevgeny Vincente Emano welcomed the court order as a relief in the province continued fight to prevent the spread of the corona virus disease in the province.

In a statement Saturday, Emano said that the stalled construction of the “COVID-19 isolation units” in various towns in will resume after the dissolution of the TRO.

Dr. Jerrie Calingasan, head of the provincial Inter-Agency Task Force Covid-19, said that the province has tallied a total of 19 COVID-19 positive cases since June, all of them were all returning overseas Filipinos and Locally Stranded Individuals.  

Opposition Vice Governor Jeremy Pelaez and two other board members Jessa Mugot and Jericho Khu filed a “declaratory relief” and TRO to stop the disbursement of the 2020 Budget for the non-posting of the approved Ordinance.
